By purchasing through our website you are purchasing goods which will result in a binding contract.

We will only sell to customers who are 18 years of age or older.

The Christmas Forest and www.christmasforest.co.uk are trading names of Bushbay Ltd.

Please read this information carefully, which relates to your usage of this website.

Any claims/complaints must be in writing (email – payments@christmasforest.co.uk) or by phone within 48 hours of receipt of goods. All claims in relation to a perishable item must be accompanied with a photo that clearly shows the concerns being raised. This photo must also be received within 48 hours of receipt of goods.

We reserve the right to revise details and prices at any time and without notice. We undertake to guarantee to hold the price at the time of your order. All items advertised by us are subject to availability. We reserve the right to alter ordering terms and to decline service to any individual. This website and everything contained in it is copyright of Bushbay Ltd.

We reserve the right to allow for the possibility of supplying substitute goods in the event of us not being able to supply the specific goods ordered. The substituted goods will be of equivalent quality and price to those ordered. If you are unhappy with the substitute goods we will meet the return charge. We will contact you first if this unlikely event happens.

Delivery Charges

Standard delivery – you choose the date and a morning (7am-1pm) or afternoon (1pm-6pm) slot: £16
Premium delivery – evening (6pm-11pm) and Saturday morning (8am-2pm) deliveries on a specified date: £21

Pre-dispatch

Deliveries will only be left unattended if you give us permission to do so. However goods are left at your own risk and we cannot be held responsible for any damage or loss of your goods.

During our order process you can give instructions for the driver as to where to leave your delivery if no one is in, we cannot guarantee these instructions will be followed as it is at the discretion of the driver. Alternatively you can elect to have your goods left with a neighbour, should you be unable to take delivery in person.

Post-dispatch

We will send an e-mail to your email address to inform you of the dispatch of your goods.

Delivery

On receiving your goods please check them BEFORE the driver leaves. If there is any problem please call us immediately on 01865 427067, option 3.
We endeavour to deliver your Christmas tree in the time slot you have chosen (morning – 7am-1pm, afternoon – 1pm-6pm, evening – 6pm-11pm, Saturdays – 8am-2pm). However, due to seasonal traffic and weather conditions, we cannot guarantee delivery during these time slots. In that case, our delivery team will call you to inform you of any delays and likely ETAs.
In accordance with the United Kingdom’s Consumer Contracts Regulations, we cannot accept returns for perishable goods after 48 hours of delivery, as trees and wreaths are freshly cut/prepared to order.

If for any reason you are not in during the time slot you have chosen, we will call you to arrange re-delivery. We reserve the right to charge you for re-delivery at another time.

If you give permission for your goods to be left without anyone to receive it, you do so at your own risk.

We cannot guarantee any special delivery instructions will be followed as it is at the discretion of the driver.

Bushbay Ltd cannot be held responsible for any of the actions of our third party courier drivers.

Bushbay Ltd cannot be held responsible for problems caused by adverse weather/road conditions.

Our courier is contracted to deliver to your building. If you live in flats they are not obliged to take it to your door, this is at the discretion of the driver.

You must let us know if your order has not been delivered within 5 working days of the required date. After 5 working days we cannot be held responsible for the non-delivery of your goods.

If you have any problems relating to delivery before the date your tree is due please call 01865 427 067 option 3.

On the day of delivery only, to track your tree, call 01865 427 067 and press option 2.

Last delivery date for 2014 is Tuesday 22 December.

Payment Processing

We accept payment with major credit and debit cards. Credit and debit card payments will be processed through the secure payment service provided by Sage Pay and Paypal.

The prices shown include VAT. The price paid for delivery of Christmas trees includes delivery to your door, but excludes net removal and decoration.

Installation cost is an extra £10 (including VAT). Installation is only guaranteed in a Cinco stand bought according to our size recommendations. We will attempt to install trees in other stands, but it may not be possible. There are Cinco stands available for sale on our delivery vans.

Full payment will be taken on the date of order. Funds must be received by us in full prior to dispatch of your order.

Product Quality

Trees and wreaths are either living or made from living material so there will be some variation from those depicted in the photographs on our website.

Any concerns or complaints about cut/pot grown trees or wreaths have to be accompanied by a photo before we can progress the complaint within 48 hours of receipt. This will allow us to assess your product and can be used in any claims against the Courier provider. Moreover it will help us to quickly resolve any concerns you have.

If, for whatever reason, you are unable to provide us with a photo of any damaged or sub- standard perishable items (trees or wreaths) it is the buyer’s responsibility to return the goods to us. The cost of this return along with the original cost of the item will be refunded in full following an inspection of the goods that verifies the original complaint.

We strongly recommend that you do not take delivery of any cut Christmas tree prior to the 27th of November as the ability of the tree to last till Christmas will be greatly reduced.

We cannot be held responsible for the deterioration in quality of any Norway spruce that is used indoors. We recommend that you have Norway spruces delivered as close as possible to Christmas as their needles do drop (especially once the tree is brought indoors to warm environments.

Our trees are graded for quality twice before being cut. They are carefully inspected and graded again prior to being dispatched. We only sell trees of the highest standard.

The tree you buy is freshly cut prior to dispatch. All tree heights are measured to halfway up the leader (stem at the top of the tree). Your tree will be approximately half a foot taller than the measurements shown.

Christmas trees are grown in a natural environment and are harvested in variable weather conditions. Please take care when unpacking your tree as we will not be held responsible for any damage caused by debris that may fall from the tree.

We cannot be held responsible for any living (pot grown) tree that dies after 25th December of the year of purchase. Christmas trees and Christmas wreaths are ‘perishable goods’ and have a limited display life. Put your tree or wreath up as close to Christmas as possible to ensure a fresh healthy looking tree over the festive period. If you want to display your tree for a prolonged period you may have to replenish it with a fresh tree. For the best results follow our tree care guide closely.

We cannot be held responsible for problems arising with any tree or wreath in relation to needle drop, colour, general product freshness and longevity after 14 days from receipt of goods. To help improve product longevity please refer to our tree care guide.

We cannot sell stands, firewood or lights THROUGH THE WEBSITE without the purchase of a tree. Where this occurs, we will contact the customer by email and inform them. We will make a full refund within 30 days of payment.

Product Handling

Care should be taken when handling the products. The safe use of the product is your responsibility and you accept that any loss or injury arising from its use will be your responsibility. Please be aware that needles from the Norway Spruce can cause a mild skin irritation.

Cancellation

Non-perishable goods (excludes Christmas trees and wreaths)

We can accept cancellation of an order up to 24 hours before it is due to be dispatched. In the event that you wish to cancel your purchase we request that you contact us by email at payments@christmasforest.co.uk, or by phone on 01865 427 067 and press the Online enquiries option.

Until the goods are returned it is your responsibility to take reasonable care of them. They should be returned with their original packaging, unused and in saleable condition.

All goods returned to stores must be accompanied by the original receipt as proof of purchase.

Perishable Goods (includes all pot-grown and real cut Christmas trees and wreaths)

We cannot accept cancellations any later than 24 hours before due shipment as trees and wreaths are freshly cut/prepared to order. If you wish to cancel your purchase before this time we require notice of cancellation in writing to payments@christmasforest.co.uk or by phone to 01865 427 067 option 3 (online enquiries).

You may add items to your order or change the order up to 48 hours before your tree is due to be delivered. Either email us at payments@christmasforest.co.uk or phone us on 01865 427 067 option 3 (online enquiries) and give us your order number plus your updated request. After this time it will be at the discretion of our packing team whether changes can be made.

Damaged Goods

In the unlikely event that the goods are damaged in transit please tell your driver immediately, refuse to take delivery, email or call us immediately (within 48 hours). Please give us as much information as possible regarding the damage so that we can arrange a replacement or refund as appropriate.

This will allow us to assess your product and can be used in any claims against the Courier provider. Moreover it will help us to quickly resolve any concerns you have.

If you refuse to accept delivery of an order for any other reason you will incur an administration charge of £10.00 and will not be entitled to a refund.

Security & Privacy

We are a member of SSL Security. We are 100% committed to protecting your security and privacy but we do need to collect some information from you to enable us to process your order. We need your name and address to know where to send your order, your card details to obtain payment and your telephone number and e-mail address to enable us to contact you should there be a problem with your order.

We promise to keep all information that we collect from you in a safe and secure way. We promise not to give any details to a third party with the exception of Sage Pay and PayPal our secure payment service providers.

Christmasforest.co.uk may contact you in the future to enquire as to whether you would be interested in purchasing from us next Christmas. If you do not wish this, please tick the box requesting us not to include you in future mailings and we will remove your name from our list. If you use the website, you are responsible for maintaining the confidentiality of your account and password and also for restricting access to your computer to prevent un-authorised access to your account. You agree to accept responsibility for all activities that occur under your account or password.
